Are public officials morally justified in threatening violence, engaging in deception, or forcing citizens to act for their own good? Hospital ethics, familiar enough in practice but surprisingly neglected in the literature, deals with the ethical problems that arise distinctively or typically in hospitals. More precisely, it consists of the ethical principles that shouldgovern 1) the conduct of healthcare professionals and other staff in their capacities as members of the hospital as an institution, and 2) the conduct of the hospital itself as an institution. Democracy is prone to what may be called presentism – a bias in the laws in favor of present over future generations. I identify the characteristics of democracies that lead to presentism, and examine the reasons that make it a serious problem. Then I consider why conventional theories are not adequate to deal with it, and develop a more satisfactory alternative approach, which I call democratic trusteeship. Present generations can represent future generations by acting as trustees of the democratic process. (...) Moral disagreement about public policies—issues such as abortion, affirmative action, and health care—is a prominent feature of contemporary American democracy. Yet it is not a central concern of the leading theories of democracy. The two dominant democratic approaches in our time—procedural democracy and constitutional democracy—fail to offer adequate responses to the problem of moral disagreement. Both suggest some elements that are necessary in any adequate response, but neither one alone nor both together are sufficient. We argue here that an adequate (...) conception of democracy must make moral deliberation an essential part of the political process. In some sense, bioethics was built on conflicts. Abortion, physician‐assisted suicide, patients’ demand for autonomy all are staple and contentious issues. And the controversies continue to proliferate. What forum best serves such debates? A look at political theories of democracy can help answer that question. The most promising for bioethics debates are theories that ask citizens and officials to justify any demands for collective action by giving reasons that can be accepted by those who are bound by the action. Although oppressive social practices like capitalism are often portrayed as static, totalizing social 'structures' with 'logics' and 'imperatives' that must be accommodated politically and economically, such portrayals are problematic both theoretically and politically. They rest on determinist and essentialist conceptions of social practices, and they curtail the scope of politics, government regulation, and human action and creativity. Fortunately, social practices can instead be conceptualized as thoroughly social, historical, and contingent, and thus susceptible to political intervention and reworking, as many feminist, (...) post-structuralist, and anti-economistic Marxian theorists do. Attempting to build on such alternative conceptualizations, I argue that Judith Butler's concept of reiteration provides a particularly useful, in-depth theorization of power, the mechanisms enabling social practices to endure and change, and the role of the individual and collectivities in perpetuating and challenging social practices such as capitalism. In so doing, the concept of reiteration offers a compelling and detailed non-voluntaristic account of human agency. Butler's work is thus helpful in theorizing and empirically investigating both the obstacles to and the possibilities for resisting exploitation and altering unjust social practices. (shrink)
